Yasigu.AI - Terms and Conditions of Use

Welcome to Yasigu.AI! These Terms and Conditions ("Terms") govern your access to and use of the Yasigu.AI application (the "App"), owned and operated by Yasigu LLC ("Yasigu," "we," "us," or "our"). By accessing or using the App, you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not access or use the App.

1. Acceptance of Terms
By using Yasigu.AI, you acknowledge that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy. We may update these Terms from time to time, and we will notify you of any material changes. Your continued use of the App after such changes constitutes your acceptance of the new Terms.

2. Use of the App

3. Account Creation and Security
To access certain features of the App, you may be required to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized access to or use of your account.

4. Payment and Subscription (If Applicable)

Subscription Fees: Access to certain features of Yasigu.AI requires a paid subscription. Subscription fees are billed in advance on a [Monthly/Annual] basis and are non-refundable except as expressly stated in our Refund Policy.

Payment Processing: We utilize Paddle.com ("Paddle"), a SaaS Merchant of Record, for payment processing. By subscribing to Yasigu.AI, you agree to Paddle's terms and conditions and privacy policy. Yasigu LLC does not directly handle your credit card information. Paddle handles all payment routing, tax collection, compliance, invoicing, subscription management, renewals, reporting, and fraud protection.

Automatic Renewals: Your subscription will automatically renew at the end of each billing cycle unless you cancel it before the renewal date. You can manage your subscription and cancel automatic renewal through your account settings within the App.

Price Changes: We reserve the right to change our subscription fees at any time. We will provide you with reasonable notice of any price changes before they take effect.

Chargebacks: In the event of a chargeback, you are responsible for all associated fees imposed by Paddle. We reserve the right to suspend or terminate your account if a chargeback occurs. We will cooperate with Paddle to dispute chargebacks where appropriate.

5. Intellectual Property
The App and its content, including but not limited to text, graphics, logos, and software, are owned by Yasigu LLC or its licensors and are protected by copyright, trademark, and other intellectual property laws. You may not use our intellectual property without our express written permission.

6. Disclaimer of Warranties
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

7. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, YASIGU LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE APP, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATED TO THESE TERMS OR THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID US, IF ANY, FOR ACCESS TO THE APP IN THE SIX (6) MONTHS PRECEDING THE CLAIM.

8. Indemnification
You agree to indemnify and hold harmless Yasigu LLC and its affiliates, officers, directors, employees, and agents from any and all claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or related to your use of the App, your violation of these Terms, or your violation of any rights of another.

9. Termination
We may terminate your access to the App at any time, with or without cause, and with or without notice. Upon termination, your right to use the App will immediately cease.

10. Governing Law

11. Refund Policy and Right to Cancel
Yasigu LLC utilizes Paddle for payment processing, and our refund policy aligns with Paddle's Buyer Terms. As a consumer, you have the right to cancel your purchase within 14 days without giving any reason, subject to the following conditions:

The cancellation period expires 14 days from the day after the completion of the transaction.

To meet the cancellation deadline, you must inform Paddle of your decision before the 14-day period expires.

For subscription services, this right to cancel is only present following the initial subscription and not upon each automatic renewal.

Effect of Cancellation:
If you cancel within the permitted timeframe, Paddle will reimburse all payments received from you without undue delay and within 14 days of being informed of your decision. Reimbursement will be made using the same payment method you used for the initial transaction, at no additional cost to you.

Exception to the Right to Cancel:
Your right to cancel does not apply to digital content that you have started to download, stream, or otherwise acquire, or to products which you have already benefited from.

Refund Policy:
Outside of the 14-day cancellation period, refunds are provided at the sole discretion of Paddle and on a case-by-case basis. Refunds may be refused if there is evidence of fraud, refund abuse, or other manipulative behavior.

This policy does not affect your rights as a consumer in relation to products which are not as described, faulty, or not fit for purpose.

12. PCI Compliance
As Yasigu LLC uses Paddle as a Merchant of Record for Payment collection services, Yasigu does not collect, transmit or store any cardholder data.

15. Entire Agreement
